Terms of Service

01The agreement

By creating an account, or by using the platform after these terms take effect, you agree to them. If you do not agree, do not create an account and do not use the platform.

These terms incorporate the Privacy Policy, the Risk Disclaimer, and the Refund and Cancellation Policy. New registrations must accept the Terms of Service and the Privacy Policy before an account is created.

02Eligibility and accurate information

You must have the legal capacity to enter into this agreement where you live, and you must be old enough to do so. You must not use the platform if doing so would breach a law or restriction that applies to you.

Register with an email address you control and keep your account information accurate. Access decisions, support, and payment correspondence all depend on reaching the right person, so an account registered with someone else's address or with details you know to be wrong may be suspended.

03Account security

You are responsible for your password and for anything done through your account. Use a strong, unique password. If you sign in with Google, the security of that Google account becomes the security of your platform account.

Tell us immediately at info@phaneshane.xyz if you believe your account has been accessed by someone else. We may suspend an account to contain a suspected compromise.

04Permitted and prohibited use

You may use the platform and the products you have access to for your own lawful purposes.

You may not:

• share, resell, sublicense, lend, or transfer your account or your access to anyone else;
• use an account that was not issued to you;
• attempt to reach data, accounts, products, or systems you have not been given access to;
• probe, scan, overload, or interfere with the platform, its infrastructure, or its providers;
• circumvent authentication, rate limiting, entitlement checks, or any other control;
• scrape, republish, redistribute, or resell platform content or product output;
• reverse engineer or attempt to derive the underlying models or source of a product;
• use the platform to break a law, to defraud anyone, or to harm anyone.

05Access requests and manual payment verification

Access to a product is requested through your account and reviewed by a person. Nothing about the process is automatic: there is no checkout, no card processing, and no subscription billing on this platform.

Payment is arranged through the official support channels listed on the contact page, confirmed outside the application, and then recorded by an administrator. Confirm the product, the access period, the price, and the payment method with us before you pay anything.

06Entitlements are the source of truth

Access to a product exists only where the platform holds an active server-side entitlement for your account and that product, within its start and expiry dates. That entitlement is the authoritative record, and it is checked on the server every time access is attempted.

• Payment status alone never grants access. A recorded, confirmed, or even completed payment is not access until an entitlement exists.
• Approval text alone never grants access. A message, email, or approval note saying access was granted is not access; the entitlement is.
• What you can see is not what you are authorised to use. A visible link, button, or product page is navigation, not permission. Access is decided on the server.
• Access ends when the entitlement expires or is revoked, at that moment, without further notice.
• A suspended account is blocked even if an entitlement has not expired. Account status and entitlement are separate conditions and both must be satisfied.

If you believe an entitlement is missing or wrong, contact support rather than attempting to reach the product another way.

07Start, expiry, suspension, revocation, and termination

Access begins when the entitlement starts, which may be later than the moment it is created. It ends at the expiry recorded on the entitlement.

We may suspend or revoke access, or close an account, where we reasonably believe there has been a breach of these terms, abuse of the platform or another user, a security threat, fraud or a reversed or disputed payment, non-payment for the access in question, or where we are required to act. Where the circumstances allow it, we will tell you why.

You may stop using the platform at any time and may ask us to close your account. Closure does not by itself create a refund; the Refund and Cancellation Policy explains what does.

08One account, one person

Accounts and entitlements are personal to you and are not transferable. Sharing credentials or access with anyone else is a breach of these terms and may result in suspension or revocation without refund.

09Availability, maintenance, and change

We aim to keep the platform available, but we do not promise uninterrupted or error-free operation. The platform depends on third-party providers, and an outage at a provider can interrupt it.

We may perform maintenance, change or remove features, and discontinue a product. Where a product is discontinued during a paid access period, contact us and we will deal with it under the Refund and Cancellation Policy.

Products described as in development, planned, or not yet released are exactly that. Nothing on this site should be read as a commitment that a particular product will be released, or released on a particular date.

10Intellectual property and licence

The platform, its content, its interfaces, and the products made available through it remain ours or our licensors'. Nothing here transfers ownership to you.

While your entitlement is active you have a personal, non-exclusive, non-transferable, revocable licence to use the relevant product for your own purposes, subject to these terms. You may not copy, redistribute, publish, or create derivative works from the platform or its output except as we have agreed in writing.

11Your decisions are yours

The platform provides market intelligence and analytical tools. It is informational and educational. It is not investment, financial, legal, tax, accounting, brokerage, or fiduciary advice, and it is not a recommendation to enter into any transaction.

Any decision you take using this platform is your decision, made on your own assessment and at your own risk. Read the Risk Disclaimer, which forms part of these terms.

12Disclaimers and limits

To the extent permitted by the law that applies to you, the platform and its products are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that any information, output, indicator, or forecast is accurate, complete, timely, or suitable for you.

To the extent permitted by that law, we are not liable for trading or investment losses, lost profits, lost opportunity, loss of data, or indirect or consequential loss arising from your use of the platform. Where liability cannot be excluded, it is limited to the amount you paid us for the access in question during the period in which the claim arose.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited.

13Changes to these terms

We may update these terms as the platform develops. The effective date and version at the top of this page identify the current document. Where a change is material we will ask you to accept the new version the next time you sign in. Continuing to use the platform after a change means you accept it.

14General

These terms, together with the documents they incorporate, are the whole agreement between you and us about the platform. If any part is found unenforceable, the rest continues to apply. Our not enforcing a provision on one occasion is not a waiver of it.

You are responsible for complying with the laws that apply to you where you are, including any restriction on the instruments or markets a product discusses. Local law may give you rights that these terms cannot displace, and nothing here is intended to displace them.
